West Virginia

In 2009, West Virginia introduced nutrition labeling. The Senate Committee on Health and Human Resources introduced a bill that was signed by the Governor on June 5, 2009 to implement nutrition labeling in restaurants. Calories will be made available at the point of purchase in national chains.

Also introduced in 2009 was a joint effort by the House and Senate to create the ‘Governor’s Office of Health Enhancement and Lifestyle Planning. ’ The group would have developed nutrition labeling standards for foodservice establishments with 15 or more locations in 15 states. The bill passed in the Senate, but was not addressed by the House before the 2009 legislative session ended.

The West Virginia House has also introduced a bill that would regulate food and beverages available in the public school system. Foods available to students must contain no more than 200 calories, limit total fat to 35% of total calories, limit saturated fat to less than 10% of total calories, limit trans fat to less than 0.5 grams, reduce sugar to no more than 35% of calories excluding fruit, and contain less than 200 milligrams of sodium. The House Health and Human Resources Committee is reviewing the bill.

In 2008, West Virginia adopted a bill that would help bridge the barrier to illiteracy with students understanding the nutrition label on products. The second bill introduced would have established the ‘Healthy Lifestyles Restaurant Calorie Posting Program,’ which would have given participating restaurants an image to display; however, the bill died at the end of the legislative session. A third bill introduced in 2008 would have eliminated trans fat from public schools, but the bill also died at the end of the legislative session.
