Delaware

In 2007, Delaware introduced a bill that would prohibit foods with a trans fat content of more than 0.5 grams per serving from being available or served to students in grades K-12 in all chartered and public schools. The bill was still under the review of the Senate Finance Committee at the end of the 2009 legislative session.

On April 30, 2009, the Delaware Senate introduced a menu labeling bill. The menu labeling requirement would affect foodservice establishments with 10 or more locations in Delaware or nationwide. Menus must list calories, grams of saturated fat, grams of carbohydrates, and milligrams of sodium per menu item. On menu boards and food tags calories must be listed, and additional nutrition information must be available upon request. A statement must be included that states what the U.S. Food and Drug Administration recommendations concerning limits of grams of saturated fat and milligrams of sodium for a 2,000 calorie diet are, but also that those recommendations may vary depending upon individual diet needs. On January 21, 2010, the Delaware Senate passed the menu labeling bill. The bill has moved to the Delaware House where the Economic Development, Banking, Insurance, and Commerce Committee is reviewing the bill.
